ArtfulIntent hosts work uploaded by artists. We respect copyright, and we respond promptly to properly made reports of infringement under the Digital Millennium Copyright Act (17 U.S.C. § 512).
1. Designated Agent
Copyright notices must be sent to our Designated Agent, registered with the U.S. Copyright Office:
Designated Agent: Jamel Robertson
Organization: Artful Intent
Email: j.robertson@artfulintent.com
Mailing address:
1248 CarMia Way #1014
Richmond, VA 23235
United
States
Notices sent anywhere other than the address above — including general support channels — may not be treated as effective notice.
2. Reporting Infringement
If you believe work on ArtfulIntent infringes your copyright, send our Designated Agent a written notice that includes all six of the following. A notice missing any of these may not be legally effective, and we may ask you to resubmit.
- Your physical or electronic signature, as the copyright owner or someone authorised to act on their behalf.
- Identification of the copyrighted work you say has been infringed.
- Identification of the material you say is infringing, with enough detail for us to find it — a direct link to the listing is best.
- Your contact details: address, telephone number, and email address.
- A statement that you believe in good faith that the use is not authorised by the copyright owner, its agent, or the law.
- A statement that the information in your notice is accurate, and — under penalty of perjury — that you are the copyright owner or authorised to act on their behalf.
On receiving a complete notice, we will remove or disable access to the material promptly and notify the artist who posted it, including a copy of your notice.
Knowingly making a material misrepresentation in a takedown notice can make you liable for damages, including costs and legal fees (17 U.S.C. § 512(f)).
3. If Your Work Was Removed in Error
If your listing was removed and you believe that was a mistake or a misidentification, you may send our Designated Agent a counter-notice containing:
- Your physical or electronic signature.
- Identification of the material that was removed, and where it appeared before removal.
- A statement, under penalty of perjury, that you believe in good faith the material was removed as a result of mistake or misidentification.
- Your name, address and telephone number, and a statement that you consent to the jurisdiction of the federal district court for your address (or, if outside the United States, for any district in which we may be found), and that you will accept service of process from the person who submitted the original notice.
We will forward your counter-notice to the person who filed the original claim. Unless they file a court action seeking to restrain you, we may restore the material in 10 to 14 business days.
4. Repeat Infringers
We maintain and enforce a policy of terminating, in appropriate circumstances, the accounts of members who are repeat copyright infringers. Listings removed following a valid notice are recorded against the account that posted them. An account that accumulates repeated valid claims may have its listings removed and its access to ArtfulIntent ended, with any membership cancelled.
5. What You Agree To When You List Work
- You own the work you upload, or you have the rights necessary to sell and display it.
- You keep ownership of your work. You grant ArtfulIntent a licence to host, display and promote it for the purpose of running the marketplace.
- You may not upload work that belongs to someone else, including AI-generated work trained to reproduce an identifiable artist's protected work without permission.
- Every listing is reviewed before it becomes visible to buyers. Review is not a legal clearance, and it does not transfer responsibility for a listing away from the artist who posted it.
This page describes our process. It is not legal advice. If you are unsure whether your work has been infringed, or how to respond to a notice, speak to a lawyer.
